This privacy policy defines and informs you of the manner in which Nouvelle-Calédonie Tourisme / New Caledonia Tourism uses and protects the personal data that you transmit to us, where applicable, when you use the present website accessible from the following URL: sg.newcaledonia.travel (hereinafter the “Website”).
All operations on your personal data are carried out in compliance with the regulations in force and in particular with Law No. 78-17 “Informatique et Libertés” of January 6, 1978 as amended and Regulation No. 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“Regulation”).
Please note that this privacy policy may be modified or supplemented at any time by New Caledonia Tourism, in particular in order to comply with any legislative, regulatory, case law or technological developments. In such a case, the date of the update will be clearly identified at the top of the present policy. These modifications are binding on the User as soon as they are put online. The User of the Website acknowledges that he/she has read and accepted the present Policy at the same time as he/she has accepted the General Conditions of Use of the Website. If the user disagrees with these terms, he/she is free not to use the Website and not to provide any personal data.
Object and scope
In general, you may visit the New Caledonia Tourism Website without communicating any personal information about yourself. In any case, you are in no way obliged to transmit this information to New Caledonia Tourism.

2.CUSTOMER DATA
Types of data collected
When data is collected, the User will be informed whether certain data is mandatory or optional. Data identified by an asterisk on the registration form is mandatory.
In addition, New Caledonia Tourism may collect personal data for other purposes, taking care to obtain the prior consent of the persons concerned.
In particular, New Caledonia Tourism may collect the following data:
- Identity: surname, first names, address, telephone number (landline or mobile), e-mail address, date of birth;
- Contact data: messages sent to the Website via contact forms (“Ideas or suggestions”, correspondence that may eventually be sent to us.
- Data relating to newsletter subscriptions: surname, first name, address, telephone number (landline or mobile), e-mail address.
- Traffic statistics: IP address, cookies, for example, pages consulted by the user, date and time of consultation (see details on the Cookies Policy page).
Identity of the Data Controller
Personal data is collected by New Caledonia Tourism, Economic Interest Grouping. It is registered in the Nouméa Trade and Companies Register under number C 629618. Its registered office is located at 20 rue Anatole France Nouméa Centre BP 688 – 98845 Nouméa Cedex. Ms Julie LARONDE represents it, in her capacity as Director.
Finalities
New Caledonia Tourism is likely to process your Personal Information:
- for the purposes of providing you with the information or services you have requested (in particular: sending the Newsletter, downloading brochures); and/or
- for the purpose of collecting information enabling us to improve our Website, our products and services (in particular by means of cookies); and/or
- for the purpose of being able to contact you about various events relating to New Caledonia Tourism, including in particular Website updates and/or responses to contact forms.
How long we keep your Personal Information
Your Personal Information is kept by New Caledonia Tourism only for the time corresponding to the purpose of the collection as indicated above, which in any event may not exceed 48 months.
Legal basis
The processing that we implement under this policy all have as their legal basis the implementation of contractual or pre-contractual measures or, in certain cases, the consent of the customer (e.g.: sending commercial prospecting messages).
3. RECIPIENTS OF DATA
Only New Caledonia Tourism is the recipient of your Personal Information. This information, whether in individual or aggregated form, is never transmitted to a third party, notwithstanding the subcontractors that New Caledonia Tourism calls upon. Neither New Caledonia Tourism nor any of its subcontractors market the personal data of visitors and Users of its Website.
4. COMPUTER RIGHTS AND FREEDOMS
In accordance with Act no. 78-17 of January 6, 1978, as amended, and Regulation (EU) 2016/679 on the protection of personal data, you have the following rights over your data: right of access, right of rectification, right to erasure (right to be forgotten), right of opposition, right to limitation of processing, right to portability. You may also define directives relating to the retention, deletion and communication of your personal data after your death.

Right of access and communication of data
You have the right to access the Personal Information that concerns you.
However, due to New Caledonia Tourism obligation of security and confidentiality in the processing of personal data, you are informed that your request will be processed subject to you providing proof of your identity, in particular by producing a scan of your valid identity document (in the event of a request via our dedicated electronic form) or a signed photocopy of your valid identity document (in the event of a request sent in writing).
New Caledonia Tourism informs you that it will be entitled, where appropriate, to oppose manifestly abusive requests (due to their number, repetitive or systematic nature).

Right to rectify data
Under this right, legislation entitles you to request the rectification, updating, blocking or deletion of data concerning you that may prove to be inaccurate, erroneous, incomplete or obsolete.
Also, you can define general and specific directives relating to the fate of personal data after your death. Where applicable, the heirs of a deceased person may request that the death of their loved one be taken into consideration and/or that any necessary updates be carried out.

Right to object
The exercise of this right is only possible in one of the following two situations:
- When the exercise of this right is based on legitimate grounds; or
- When the exercise of this right aims to prevent the data collected from being used for commercial prospecting purposes.

5. ADDITIONAL PROVISIONS
Timeliness of response
New Caledonia Tourism undertakes to respond to your request for access, rectification or opposition or any other additional request for information within a reasonable period of time, which may not exceed 1 month from receipt of your request.
Authorized service providers and transfer to a non-European Union country
New Caledonia Tourism informs you that it has recourse to its authorized service providers to facilitate the collection and processing of the data you have communicated to us. These service providers may be located outside the European Union and have communication of data collected through the various forms present on the Website (with the exception of the form allowing you to exercise your Data Protection rights which is proposed and operated by New Caledonia Tourism).
New Caledonia Tourism has previously ensured that its service providers have implemented adequate safeguards and comply with strict conditions regarding confidentiality, use and data protection. In particular, care has been taken to ensure that there is a legal basis for any transfer of data to a third country.
Complaint to the competent authority
If you consider that New Caledonia Tourism is not complying with its obligations with regard to your Personal Information, you may submit a complaint or request to the competent authority.
